If the documentary is not halted by the court, the commission believes that the country would descend into chaos.

The documentary, titled “Ganja Gold: The Journey to Industrial Hemp Cultivation, examines the present legislative framework controlling the industrial production of Indian hemp, as well as the economic opportunities that exist. This comes after the Narcotics Control Commission Act of 2020 was passed (Act 1019).

However, the Narcotics Control Commission claims that airing such a program is illegal, and has asked the High Court to place an injunction on TV3 and its affiliates from doing so.

Despite the fact that the applicable legislation allows for a license to be given to produce cannabis with not more than 0.3 percent THC content for industrial and medical purposes only, the commission claims that the provision has yet to be implemented.

The commission claims that activists, organizations, and the general public have misinterpreted the provision and that the applicant is of the strong belief that if this documentary is permitted to screen, it would deepen this mistake and lead to anarchy.

That the said documentary is seeking to promote an enterprise relating to Cannabis which is a narcotic drug or plant as such making this documentary illegal and the respondent should be prohibited from showing the said documentary”, the commission averred.

Meanwhile, the hearing has been scheduled for Monday, 26th 2021.
